Terms of Service

You must be at least 18 years of age to use StudyHaul. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. StudyHaul is designed for professionals and students preparing for professional licensing examinations.

StudyHaul is an AI-powered exam preparation platform that helps professionals and students identify knowledge gaps and build personalized study plans. The platform includes diagnostic exams, AI-generated study content and knowledge modules, adaptive flashcard decks with spaced repetition, a Question Bank with multiple practice modes (full practice exams, custom practice, missed question review, and quick drills), a Practice Lab for generating custom case-based study sessions, progress tracking and score reports, and a credit-based system for accessing premium AI-generated materials.

StudyHaul does not guarantee, warrant, or promise that you will pass any exam, achieve any particular score, or obtain any professional license or certification as a result of using our platform.

Exam outcomes depend on many factors beyond any preparation tool, including but not limited to your prior knowledge, study habits, time invested, test-taking conditions, and the specific content of the exam you take. StudyHaul is a study aid — not a guarantee of results. You acknowledge and agree that:

• Your use of StudyHaul does not create any expectation, right, or entitlement to a passing score on any examination
• We make no representations about the likelihood that you will pass or fail any exam
• Score reports, study plans, and progress indicators within the platform reflect your performance on StudyHaul materials only and are not predictive of actual exam outcomes
• You are solely responsible for your exam preparation and results
• No refund, credit, or compensation will be owed to you based on exam outcomes

To use StudyHaul, you must create an account using a valid email address and password, or through Google authentication. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information during registration and keep your account information current.

Access to premium features requires purchasing an exam license. Licenses are sold on a per-exam basis with a fixed duration of 90 days from activation. If you need more time before your exam, you may purchase a 30-day extension on an active license at half the base license price. When your license expires, your access to premium features for that exam will end, though your account, score reports, and study history will remain accessible.

• All payments are one-time purchases, not recurring subscriptions
• Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service
• License durations begin at the time of activation and cannot be paused or transferred. Extensions are available on active licenses as described above.
• Pricing may change at any time. Existing purchases will not be affected by price changes
• Refund eligibility is described in the Refunds section below

StudyHaul uses a credit-based system for AI-powered features and premium content.

• Credits are non-transferable and tied to your account
• Purchased credits do not expire
• Bonus credits granted at signup or with license activation are provided at our discretion and may be modified or discontinued
• Credits have no cash value and cannot be redeemed for currency
• Credits may be used to unlock premium flashcard decks, generate custom study sessions in the Practice Lab, and access other AI-powered features
• Credit costs vary by feature and may be adjusted. Current costs are displayed before any credit-consuming action
• Credits spent on AI generations are automatically refunded if the generation fails due to a system error

Whether a purchase can be refunded depends on whether you have started using it.

• Exam licenses — before activation: Fully refundable within 30 days of purchase, provided you have not activated the license. A license grants no access and starts no countdown until you activate it, so an unactivated purchase can be returned in full.
• Exam licenses — after activation: Once you activate a license, your 90-day access window has begun and premium features are unlocked. Activated licenses are non-refundable.
• Pre-orders: A pre-ordered exam license is fully refundable any time before you activate it.
• Extensions: A purchased extension is refundable within 30 days of purchase if its added time has not yet begun.
• Credits: Purchased credits are refundable within 30 days of purchase if they remain unspent. Spent credits are non-refundable — except that credits are automatically returned when an AI generation fails due to a system error.
• Exam outcomes: Your performance on any examination is never a basis for a refund.

We may make exceptions to the above at our discretion — for example, a billing error or a platform fault that prevented access to what you paid for. To request a refund, email us. Approved refunds are issued to your original payment method through Stripe and typically appear within 5–10 business days.

StudyHaul may offer a referral program that lets you invite others to the platform using a personal referral code or link.

• Referral rewards, such as bonus credits, are granted at our discretion and carry the same conditions and limitations as other bonus credits described above.
• A referral reward is earned only when the person you refer completes the qualifying action we specify at the time — for example, creating an account and completing their first diagnostic. Qualifying conditions and reward amounts may change or be discontinued at any time.
• You may not abuse the referral program. Prohibited conduct includes referring yourself, creating duplicate or fraudulent accounts, using bots or other automated means, spamming, and misrepresenting StudyHaul to obtain rewards.
• We reserve the right to withhold or revoke referral rewards, and to suspend or terminate accounts, where we reasonably determine that the program has been abused or these Terms have been violated.

StudyHaul uses artificial intelligence to generate study materials, practice questions, flashcards, and explanations. Content is reviewed by professionals before publication, but you acknowledge that:

• AI-generated content may contain errors, inaccuracies, or outdated information despite review processes
• Content is for educational and exam preparation purposes only
• AI-generated materials do not constitute professional medical, legal, pharmaceutical, or other professional advice
• You should verify critical information with authoritative sources, official exam materials, and qualified professionals
• We are not responsible for any decisions you make based on content provided through the platform
• Content may not reflect the most recent regulatory changes, guidelines, or exam specifications

By creating an account and accessing any content on StudyHaul, you agree that you will not copy, reproduce, screenshot, screen-record, photograph, transcribe, or distribute any platform content by any means.

To protect our content and the investment of our content creators, StudyHaul implements technical measures including:

• Text selection and copy prevention on all platform content
• Digital watermarking that embeds your account identity into displayed content for accountability
• Monitoring systems that detect unauthorized access patterns, including developer tools usage and automated scraping
• Print prevention on all authenticated pages

Attempting to circumvent these protections, or successfully copying and distributing platform content, constitutes a material breach of these Terms and will result in immediate account termination without refund. We reserve the right to pursue legal remedies for unauthorized reproduction or distribution of our content.

StudyHaul content falls into several categories, each with distinct ownership:

• Platform-created content (knowledge modules, curated flashcard decks, exam questions, study session templates, explanations): owned by Smashed Studios LLC. You are granted a limited, personal, non-transferable license to access this content for your own exam preparation while your account is active and, where applicable, while your license is valid.
• AI-generated content from platform prompts (flashcard cards generated by admin, auto-generated study sessions, AI-written explanations): owned by Smashed Studios LLC. These are derivative works created by our AI systems using our proprietary prompt architecture, curated knowledge base, and content templates.
• User-prompted AI-generated content (Practice Lab custom study sessions, user-created flashcard decks): the text you input as a prompt is yours. The generated output (case narratives, content chunks, checkpoint questions) is a derivative work created by our platform's systems and knowledge base. You are granted a personal, non-transferable license to use the generated content for your own study purposes. You may not redistribute, resell, or commercially exploit this generated content.
• Your personal data (study progress, scores, session history, notes): this data is yours and you may export it at any time through your account settings.

Flashcard decks on StudyHaul have different access levels:

• Free decks: Available to all users within their registered profession at no cost. One default deck is provided per profession.
• Premium decks: Unlockable with credits. Access may be permanent or time-limited, as specified at the time of purchase.
• Exam bundle decks: Automatically available when you hold an active exam license for the associated exam. Access ends when your license expires. These decks may also be purchased separately with credits.
• Custom decks: Decks you create are always accessible to you while your account is active.

Content within flashcard decks is platform intellectual property and is subject to the Content Protection and No-Copy Agreement above.

The Practice Lab allows you to generate personalized case-based study sessions by describing your learning needs. You acknowledge that:

• Custom sessions are AI-generated and are not reviewed by human experts — accuracy and completeness are not guaranteed
• Session generation costs credits as displayed before generation. Credits are non-refundable for successfully generated sessions but are automatically refunded if generation fails
• Sessions must relate to your stated professional field — off-topic requests will be blocked and no credits will be charged
• Generated sessions are for your personal study use only and may not be shared, distributed, or commercially exploited
• We may use anonymized session quality feedback you provide (ratings and comments) to improve the service

The Question Bank provides multiple practice modes including full practice exams, custom practice sets, missed question review, and quick drills. You acknowledge that:

• The Question Bank requires an activated exam license — it is not available to free-tier users
• Questions and explanations shown during tutor mode are platform intellectual property
• Practice exam scores and results reflect your performance on StudyHaul materials only and are not predictive of actual exam outcomes
• Score reports generated from practice exams are added to your account for review but do not constitute any certification or credential
• Question content may be updated, corrected, or removed at any time to maintain accuracy

Content on StudyHaul is filtered based on your stated profession. You agree to accurately represent your professional field during registration. Accessing content outside your profession by misrepresenting your professional status may result in account termination. Some content may be available across multiple professions where educationally relevant.

You agree not to:

• Share your account credentials with others
• Copy, reproduce, screenshot, screen-record, or distribute any StudyHaul content by any means
• Attempt to reverse-engineer, scrape, extract, or circumvent content protection measures
• Use developer tools, browser extensions, or automated scripts to access, copy, or extract platform content
• Use the platform to generate content for purposes other than personal exam preparation
• Submit false or misleading information, including misrepresenting your profession
• Interfere with or disrupt the platform's operation or security measures
• Share, publish, or distribute exam questions, answers, explanations, or flashcard content from the platform
• Resell, sublicense, or commercially exploit any content generated through the platform, whether admin-created or user-prompted

StudyHaul provides mechanisms for users to flag content they believe is inaccurate, outdated, or inappropriate. We review flagged content and take appropriate action, which may include corrections, updates, or removal. Flagging content does not guarantee immediate changes.

You may choose to submit a testimonial, review, rating, or story about your experience with StudyHaul — for example, through our "Share your story" form. These submissions are entirely voluntary. By submitting one, you represent that it is truthful, reflects your genuine experience, is your own original content, and does not include confidential information or the personal information of anyone else.

By submitting a testimonial or similar content, you grant Smashed Studios LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, publish, display, adapt, and distribute that submission — in whole or in part, and together with your first name and general details such as your profession or exam — for marketing, promotional, and informational purposes across our website, application, and other channels. We may edit submissions for length, clarity, or formatting without changing their substance, and we are not obligated to use, display, or retain any submission.

If you would like us to stop displaying a testimonial attributed to you, contact us by email and we will honor the request on a going-forward basis.

All content, designs, software, algorithms, AI prompt architectures, and materials on StudyHaul are the property of Smashed Studios LLC and are protected by copyright and other intellectual property laws. This includes all exam questions, explanations, knowledge module content, flashcard deck content, case study narratives, and AI-generated materials produced by the platform, regardless of whether the generation was initiated by an administrator or by a user prompt.

Your personal study data (scores, progress, session history) remains yours. By using the platform, you grant us a limited license to process your data for the purpose of providing personalized study services and improving our AI systems. See our Content Ownership and Licensing section above for detailed ownership distinctions.

StudyHaul is an educational technology product. Content provided through the platform is for exam preparation purposes only and does not constitute professional medical, legal, pharmaceutical, or other professional advice. Always consult qualified professionals for professional guidance. We are not a substitute for formal education, clinical training, or professional mentorship.

You acknowledge that exam preparation involves inherent uncertainty. By using StudyHaul, you assume full responsibility for your exam preparation decisions, including how you allocate your study time, which materials you rely on, and whether you seek additional resources. You agree that StudyHaul is one tool among many available to you and that reliance on any single preparation tool is at your own risk.

STUDYHAUL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content, including AI-generated materials, study plans, score predictions, or performance analytics.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMASHED STUDIOS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF INCOME, PROFESSIONAL OPPORTUNITIES, OR EXAM FEES, ARISING FROM YOUR USE OF OR INABILITY TO USE STUDYHAUL.

This includes, without limitation, damages related to:

• Failing an exam after using StudyHaul
• Inaccuracies in AI-generated study content
• Reliance on score reports, study plans, or performance predictions
• Service interruptions, data loss, or technical issues
• Any decisions you make based on content provided through the platform

Our total aggregate liability for all claims arising from or related to your use of StudyHaul shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

You agree to indemnify, defend, and hold harmless Smashed Studios LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any rights of another party.

Any dispute arising from these Terms or your use of StudyHaul shall first be attempted to be resolved through informal negotiation by contacting us by email. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association, with proceedings conducted in the State of California. You agree that any arbitration shall be conducted on an individual basis and not as a class action.

You may delete your account at any time through your account settings or by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the platform will cease, and your data will be handled according to our Privacy Policy. No refund will be issued for unused license time upon voluntary account deletion.

We may update these Terms from time to time. We will notify registered users of significant changes via email or in-app notification. Continued use of StudyHaul after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the platform.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
